Offaly County Council fined €90,000 for breaches of health and safety legislation

On December twenty first, having pleaded responsible to breaches of the Safety, Health and Welfare at Work Act 2005, Offaly County Council had been handed down fines totalling €90,000 by Judge Francis Comerford at Offaly Circuit Court. 

Offaly County Council pleaded responsible to the next two costs:

  • Failure to discharge the duties of an employer as required by sections 8(1) and 8(2)(e) of the Safety, Health & Welfare at Work Act 2005 and failure to make sure the safety, health and welfare of its workers in that it failed to offer methods of work that had been deliberate, organised, preformed, maintained and revised as acceptable.
  • Failure to establish hazards and assess dangers as required by part 19(1) of the Safety, Health & Welfare at Work Act 2005 opposite to part 77(2)(a) of the Safety, Health & Welfare at Work Act 2005 and part 78 of the Safety, Health & Welfare at Work Act 2005 as amended.

The case arose following an investigation by the Health and Safety Authority into an incident that occurred on January twenty fifth 2019 leading to an worker sustaining severe accidents. The injured celebration was an observer within the work crew finishing up the work on the time of the incident.  

On January twenty fifth 2019 a piece crew from Offaly County Council had been within the course of of eradicating a lighting column at Kilbride Plaza automobile park in Tullamore which had turn out to be free and was inflicting a threat to the safety of members of the general public. During the operation to take away the lighting column, it turned dislodged and struck the injured celebration on the pinnacle, inflicting him severe head and spinal accidents. 

Mark Cullen, Chief Inspector with the Health and Safety Authority mentioned that this tragic incident arose from the shortage of having a threat evaluation carried out and a failure to offer methods of work that had been deliberate and organised. “This case is a reminder to all employers to ensure they have carried out risk assessments and put in place safe systems of work to be followed for each activity that they undertake”, he mentioned.
